1. Definitions

In these Terms and Conditions:

• "Solacen" / "We" / "Us" refers to the senior care facility operated at 27 Chaengwattana Road, Soi 14, Pak Kret, Nonthaburi 11120, Thailand.
• "Service" refers to the senior care programs offered by Solacen, including Assisted Living Residence, Wellness and Rehabilitation Stay, and Companion Day Program.
• "User" refers to any individual accessing this website or enquiring about or engaging with Solacen's services.
• "Resident / Participant" refers to any older adult enrolled in a Solacen care program.
• "Agreement" refers to the care service agreement entered into between Solacen and the family or authorised representative of a resident.

2. Acceptance of Terms

By accessing the Solacen website or engaging with our services, you confirm that you have read, understood, and agree to these Terms and Conditions. Use of the website or enquiry about our services constitutes acceptance. Individuals must be 18 years or older to enter into a service agreement with Solacen.

3. Description of Services

Solacen provides residential and non-residential senior care programs in Nonthaburi, Thailand. These include:

• Assisted Living Residence — ongoing residential care with daily living support
• Wellness and Rehabilitation Stay — short-term residential support for post-hospital or post-surgical recovery
• Companion Day Program — structured daytime community participation for seniors living at home

Service availability is subject to program capacity. Solacen reserves the right to adjust program offerings with reasonable notice.

4. Care Service Agreements

Engagement with a Solacen program is governed by a separate, written care service agreement entered into between Solacen and the responsible family member or legal representative of the resident or participant. These Terms and Conditions apply to website use and general enquiry. The care service agreement governs the specific terms of participation, including fees, admission requirements, and responsibilities of both parties.

5. User Responsibilities

When using the Solacen website, you agree to:

• Provide accurate and complete information in any enquiry or contact form submission
• Use the website for lawful purposes only
• Refrain from attempting to access restricted areas of the website or interfering with its operation
• Not transmit harmful, misleading, or offensive content through any communication channel

6. Intellectual Property

All content on the Solacen website — including text, layout, design, and imagery — is the property of Solacen or its content providers and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive licence to access and view website content for personal, non-commercial purposes only. Reproduction, redistribution, or use of website content for commercial purposes is not permitted without prior written consent.

7. Payment Terms

Program fees are set out in the relevant care service agreement and expressed in Thai Baht (฿). Payment schedules, accepted methods, and any applicable deposit requirements are specified in the individual agreement.

Requests for fee adjustments or refunds are handled in accordance with the terms of the care service agreement. Refund eligibility varies by program type and the circumstances of withdrawal.

8. Service-Specific Terms

The following applies to each program type:

• Assisted Living Residence: Monthly billing cycle as per care service agreement. Notice period for planned departure is specified in the individual agreement. Solacen reserves the right to review continued suitability of the program for each resident and will involve the family in any such discussion.
• Wellness and Rehabilitation Stay: Duration agreed at admission, typically 2 to 8 weeks. Extension is available subject to program capacity and mutual agreement. Early departure terms are specified in the care service agreement.
• Companion Day Program: Weekly billing. Attendance schedule (full-week or partial) is agreed at enrollment and may be adjusted with reasonable notice.

9. Disclaimers

Solacen provides care services with genuine attention and professionalism. However, outcomes in senior care are influenced by many individual factors including the resident's health, medical history, and personal circumstances. Solacen does not make specific representations about health outcomes or recovery timelines. Information provided on this website is for general informational purposes and does not constitute medical advice.

The website is provided "as is". While we aim to keep content accurate and current, we do not warrant the completeness or accuracy of all information on the site.

10. Limitation of Liability

To the extent permitted under Thai law, Solacen's liability in connection with care services is governed by the care service agreement. Solacen is not liable for indirect, incidental, or consequential losses arising from use of the website or from circumstances outside our reasonable control. Our total liability to any individual in connection with these Terms shall not exceed the value of services provided in the relevant period.

11. Termination

Either party may terminate a care service agreement in accordance with the notice and termination provisions contained within it. Solacen reserves the right to terminate a care relationship if continued participation is not in the best interests of the resident or the safety of others, with appropriate prior notice and family involvement wherever possible.

Access to the Solacen website may be suspended or discontinued at our discretion without prior notice.

12. Dispute Resolution

We encourage open communication and aim to resolve any concerns informally in the first instance. Families are encouraged to raise concerns directly with our care management team. Where a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing formal legal proceedings.

These Terms are governed by the laws of the Kingdom of Thailand. Any unresolved disputes are subject to the exclusive jurisdiction of the courts of Thailand.

13. General Provisions

• Entire agreement: These Terms, together with any applicable care service agreement, constitute the complete understanding between the parties regarding the subject matter herein.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our prior written consent.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the website or services after changes are published constitutes acceptance of the revised Terms.
